Terms & Conditions

This Agreement sets out the legally binding terms of your use of Enchanting Matches and your membership in the Service and may be modified by Enchanting Matches as needed, such modifications will be effective upon the date of posting to Enchanting Matches.

1. Eligibility. You must be twenty one or over to register as a member of Enchanting Matches. Membership iis void where prohibited. By using the Website, you represent and warrant that you have the right and authority to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.

2. Changes and Cancellations. Cancellations and changes can be made via email to memberships@enchantingmatches.com.

3. Standards. Enchanting Matches will not accept an advertisements placed with the following:

• is offensive to the members of Enchanting Matches, such as advertisements that promote racism, hatred or physical harm;
• harasses another person;
• involves the transmission of unsolicited mass mailing or "spamming";
• promotes information that you know is misleading or promotes illegal activities;
• promotes an illegal or unauthorized copy of another person’s copyrighted work;
• solicits personal information from anyone under 18;
• engages in commercial activities written consent of Enchanting Matches.
  

4. Delivery, Frequency and Makegood. All figures relating to the number of advertisements served as determined by Enchanting Matches shall govern, regardless of whether Member is using the services of a third party ad server. If Enchanting Matches fails to provide the guaranteed number of impressions, Enchanting Matches will make good on this contract.

5. Key Words and Phrases. Enchanting Matches offers no exclusivity on keywords or phrases. Each advertiser will be given ranking positions based upon the bid they enter on keywords/phrases.

6. Rejections. Enchanting Matches reserves the right, without liability, to reject, omit or exclude any person or to reject or terminate any memberships for any reason at any time, with or without notice to the member, and whether or not such membership was previously acknowledged, accepted, or published.

7. Licenses and Indemnification. Member grants Enchanting Matches the right to use, reproduce, publicly display and distribute member's advertisments and collateral information and warrants that Member has the right to grant such license. Member represents that the advertiser is the owner or is licensed to use the entire contents and subject matter contained in its advertisements and collateral information, including, without limitation, (a) the names and/or pictures of persons; (b) any copyrighted material, trademarks, service marks, logos, and/or depictions of trademarked or service marked goods or services; and (c) any testimonials or endorsements contained in any advertisement submitted to Enchanting Matches. In addition, Member represents that the member's advertisements and collateral information do not violate any applicable local, state or federal law or regulation. In consideration of Enchanting Matches's acceptance of such advertisements and information for publication, the advertiser and agency will jointly and severally indemnify and hold harmless Enchanting Matches and its officers, directors, shareholders, employees, accountants, attorneys, agents, parent, affiliates, subsidiaries, successors and assigns from and against any and all third party claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses, arising out of or related to: (i) Member's breach of any covenants, representations and warranties made therein, (ii) Enchanting Matches's performance under this contract, and (iii) the copying, printing, distributing, transmitting or publishing of member's advertisements or collateral information by Enchanting Matches.

8. Limitation of Liability. UNDER NO CIRCUMSTANCES WILL Enchanting Matches BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATON, FOR LOST INCOME OR PROFITS, IN ANY WAY ARISING OUT OF OR RELATED TO THIS CONTRACT, EVEN IF Enchanting Matches HAS BEEN ADVISED AS TO THE POSSIBILITY OF SUCH DAMAGES.

Privacy Policy

Enchanting Matches has the following Privacy Policy with respect to information gathered on Web pages hosted by Enchanting Matches. Such information is received by Enchanting Matches.

The terms "we" and "us" refer to Enchanting Matches.
 
The Information We Collect
 
This notice applies to all information collected on the Enchanting Matches Web site or submitted to Enchanting Matches at any time.

Personally Identifiable Information—When visiting Enchanting Matches and signing up for or using Enchanting Matches services, you may choose to supply Enchanting Matches with information that identifies you personally. For End-Users, this information may include your name and contact information, gender, birth date, occupation and industry, shipping and billing information, credit card numbers and other payment information, behavior patterns, purchase history, and other information. For Clients, this information may include the Client's name and contact information, the Client's Web site information (name, URL, visitors per day, page views per month, description, categorization), payment information, and user comments.
 
The Way We Use Information
 
We use the information you provide about yourself or others to complete the transaction for which the information is intended. Such transactions may include: administering a service, such as search, community, advertising sales, ecommerce; completing an order; replying to support requests; or contacting you if you have granted us permission to do so. Except as provided in this Privacy Policy and the End-User Agreement, we do not share this information with outside parties without your permission except to the extent that is necessary to administer the services we offer our Clients and End-Users or to comply in responding to subpoenas, court orders or other legal proceedings.
 
From time to time, we also use the information you provide about yourself or others to inform you of additions or improvements to the Enchanting Matches services.
 
Finally, we never use or share the personally identifiable information provided to us online in ways or for reasons unrelated to the ones described above without also providing an opportunity to opt-out or otherwise prohibit such unrelated uses.

To prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of information, we have put in place appropriate physical, electronic, and managerial procedures reasonably designed to safeguard and secure the information we collect online. Clients can access their personally identifiable information that Enchanting Matches collects online and maintains by logging in to their password-protected account and selecting "Edit My Profile."
 
To protect your privacy and security, we will take reasonable steps to verify your identity before granting access or making corrections to your information.
